This ticket/credential (“Pass”) is a revocable license to attend the 2023 The Chevron Championship (Tournament) at The Club at Carlton, The Woodlands, Texas for only the times and dates set forth on the front of this Pass. This Pass may be revoked without refund/other consideration if holder: (a) tampers with or attempts to transfer/re-sell/repackage this Pass; (b) violates any Tournament rules/ regulations, venue security restrictions, or the instructions of authorized personnel; (c) solicits contributions or distributes literature/promotions on or around the Tournament site without prior written permission from the Tournament; (d) uses foul/abusive language or obscene gestures, or otherwise engages in inappropriate, disruptive, or illegal behavior; as determined by the Tournament; or (e) as otherwise determined by the Tournament in its sole discretion. All items brought through the gate area into any Ladies’ Professional Golf Association (“LPGA”) controlled/sanctioned venue are subject to inspection.

It is unlawful to reproduce this Pass. No re-entry. Lost or stolen Passes may be replaced at option of Tournament organizer. Use of any parking site provided for Tournament attendees is entirely at the risk of the vehicle driver and/or owner.

ALL SALES ARE FINAL. NO REFUNDS, CANCELLATIONS OR EXCHANGES WILL BE OFFERED OR PERMITTED UNLESS OTHERWISE STATED HEREIN.

If the entire Tournament is cancelled prior to one official Tournament ball being hit, and ticket holder purchased its Pass through the “Official Tournament Pass Channels” (defined as chevronchampionship.com (and any hyperlinked accessed by a ticket purchaser through chevronchampionship.com)), Tournament will issue a refund of face value paid for the Pass (if any)(or, for a discounted Pass, the discounted Pass price paid) to the credit card, debit card, or other accepted method of payment that ticket purchaser used to purchase the Pass. The foregoing is subject to applicable law and is limited to Passes purchased directly through Official Tournament Pass Channels, and does not apply to Passes or tickets (i) purchased via the secondary market, (ii) provided on a complimentary or barter basis, or (iii) issued in connection with any sponsorship. If Passes were purchased through another method, please contact the person or entity from whom such tickets were purchased, as Tournament will not issue a refund directly to ticket holder therefor. In no event will delivery charges or any other amounts be refunded. There will be no liability on the part of any of the Releasees (defined below) for travel or any other expenses that ticket holder or anyone else incurs in connection with a canceled Tournament.

Tournament dates and times (including the opening of the gates and schedule of play) are subject to change by the Tournament, and Releasees (as defined below) in their sole discretion. If one or more rounds of the Tournament to which ticket holder possesses Passes are postponed or cancelled due to weather or any other causes beyond the reasonable control of the Tournament and Releasees, reasonable efforts will be made to accommodate the ticket holder with proof of purchase for a subsequent session, if held. Tournament and Releasees cannot guarantee ticket available, exchange of equal value or comparable seat location.  Where it is not possible to accommodate ticket holders in subsequent sessions, Tournament and the Releasees will issue a refund if Pass holder purchased his/her Pass through Official Tournament Pass Channels.

Holder (and his/her/THEIR personal representatives, assigns, heirs, and next of kin) (1) voluntarily assumes all risks and dangers incidental TO THE GAME OF GOLF or related to attending the Tournament and related activities, from both known/ unknown causes and both obvious/hidden conditions (including, without limitation, being struck by misdirected golf balls or carts, falls on or around the golf course and surrounding areas, and actions of 3rd parties), and releases the Tournament, IMG Worldwide, LLC (“IMG”), LPGA Tournament Properties One, LLC, LPGA, Mission Hills Country Club, Tournament organizers, partners, sponsors, and participating players, and EaCH of their respective affiliated, related or owned companies, and each of their respective employees, agents, contractors, volunteers, owners, managers, shareholders, licensees, officers, directors, and affiliates (“Releasees”) from any and all liability of any kind related to such risks, including without limitation, any and all loss or damage, and any claim or demands therefor on account of personal injury, death, loss or damage to personal property, whether caused by the negligent acts or omissions of the releasees or otherwise; (2) grants permission to the Releasees to utilize the holder’s likeness incidental to any recording, television or other transmission or reproduction in any medium, whether now known or hereinafter devised, worldwide and in perpetuity, (3) agrees not to transmit or facilitate transmission of any description, picture or reproduction of the Tournament or any related event or activity, including scoring-related data, without the written permission of the Tournament, IMG, and the LPGA, (4) consents to the reasonable inspection of person and property for security purposes, (5) agrees not to seek autographs of players during Tournament rounds and (6) agrees to abide by all Tournament policies and venue rules, and that a violation of these policies/rules can be cause for forfeiture of Pass and removal from the Tournament.  Prohibited items include cameras (allowed before competition days only), coolers, lawn chairs with arms, golf clubs, firearms, irritants and distractions of any kind.

Holder agrees to indemnify and save and hold harmless Releasees from and against any/all liability they may incur due to holder’s alleged acts or omissions thereof while present at or around the Tournament. Releasees shall not be responsible to holder for punitive, incidental, consequential or special damages. Holder agrees that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted in the state of California, and if any portion thereof is held invalid for any reason, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Any disputes involving the Releasees shall be resolved by arbitration in the State of California pursuant to the Commercial Rules of the American Arbitration Association then in force. A judgment upon the award rendered by the arbitrator(s) shall be final and non-appealable and may be entered in any court having jurisdiction thereof. If the Holder is a parent or guardian accompanying a minor or minors to the Tournament, by allowing the minor(s) to attend the Tournament with Holder, Holder is deemed to have given all of the foregoing grants of rights, releases and waivers on behalf of such minors.
